Proposal Protects Restaurants From Overweight Litigation

A bill approved by a Senate committee in Frankfort would protect restaurants from being sued by customers who blame them for being overweight.

The bill cleared the Senate Licensing and Occupations Committee with little debate Tuesday. It now heads to the full Senate.

The bill’s supporters said they’re aware of no lawsuits being filed in Kentucky by people who blame a restaurant for being overweight. But they said such lawsuits have been filed elsewhere.

The supporters say the bill recognizes the role of “personal responsibility” in deciding what to eat.
